AE 2019 ER
Certain Aluminum Extrusions
Notice of Expiry Review Decision

Ottawa, August 2, 2019

On March 8, 2019, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on March 17, 2014, in Expiry Review No. RR-2013-003, concerning the dumping and subsidizing of certain aluminum extrusions originating in or exported from the People’s Republic of China (China).

As a result of the CITT’s expiry review, on March 11, 2019, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the order is likely to result in the continuation or resumption of dumping and/or subsidizing of the goods.

The investigation has now been completed and today the CBSA has determined, pursuant to paragraph 76.03(7)(a) of SIMA, that the expiry of the order concerning the dumping and subsidizing of certain aluminum extrusions originating in or exported from China is likely to result in the continuation or resumption of dumping and subsidizing of the goods exported into Canada.

A Statement of Reasons that contains additional details concerning the determination made by the CBSA will be issued within 15 days. The Statement of Reasons will be posted on the CBSA’s website at: www.cbsa-asfc.gc.ca/sima-lmsi/er-rre/menu-eng.html.

The CITT will now conduct an inquiry to determine whether the expiry of its order is likely to result in injury to the Canadian industry. The CITT has announced that it will issue its decision by January 13, 2020.
