Notice of Revised Undertaking Proposals

On December 30, 2019, the Canada Border Services Agency (CBSA), pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), made a preliminary determination of dumping with respect to certain sucker rods originating in or exported from Argentina, Brazil, and Mexico.

Following a preliminary determination, SIMA provides that exporters accounting for all, or substantially all of the exports to Canada, may give a written undertaking to revise selling prices to Canada so that the margin of dumping or the injury caused by the dumping is eliminated. An undertaking takes the form of a written commitment to adhere to specific conditions in exporting goods subject to an investigation.

On January 15, 2020, the CBSA received initial proposals for an undertaking from exporting parties Metalmecanica S.A. from Argentina, Confab Industrial S.A. from Brazil, and Tubos de Acero de Mexico S.A. from Mexico. The aforementioned exporters account for all the subject goods exported to Canada during the period of investigation.

On February 28, 2020, exporting parties resubmitted undertakings superseding and revoking all previous undertaking offers by the exporters.

In accordance with subsection 49(5) of SIMA, undertaking proposals submitted by exporters to the CBSA will be made available to interested parties, subject to the CBSA’s rules of disclosure for confidential information, for a period of nine days for purposes of any representations they may wish to make. Any representations to the CBSA concerning this undertaking must be received by March 9, 2020.
