FISC 2016 IN
Certain Fabricated Industrial Steel Components
Notice of Final Determinations

Ottawa, April 25, 2017

On April 25, 2017, the Canada Border Services Agency (CBSA), pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), made final determinations of dumping in respect of certain fabricated industrial steel components (FISC) originating in or exported from the People’s Republic of China (China), the Republic of Korea (Korea) and the Kingdom of Spain (Spain), and subsidizing concerning FISC from China.

The subject goods are usually classified under the following Harmonized System (HS) classification numbers:

Note that these HS codes are for convenience of reference only. Refer to the product definition for authoritative details regarding the subject goods.

The Canadian International Trade Tribunal (CITT) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by May 25, 2017.

Provisional duties will continue to apply on imports of subject goods originating in or exported from China, Korea and Spain until the date of the CITT’s order or finding.

Additional information about these investigations is contained in a Statement of Reasons, which will be available within 15 days on the CBSA’s website at:

Margins of Dumping and Amounts of Subsidy by Exporter
Country of origin or export Exporter Weighted average margin of dumping expressed as a percentage of export price Amount of Subsidy per Metric Tonne (RMB)
China Baosteel Construction Co. Ltd. 32.9% 151.70
Modern Heavy Industries (Taicang) Co., Ltd 45.8% 607.66
United Steel Structures Ltd. 45.8% 675.47
All Other Exporters 45.8% 11,656.06
Korea SK Engineering & Construction Co., Ltd. 2.4% N/A
Hanmaek Heavy Industries Co., Ltd. 1.9% N/A
All Other Exporters 45.8% N/A
Spain Cintasa S.A. 0% N/A
All Other Exporters 45.8% N/A

Note: The margins of dumping reported in the table above are the margins determined by the CBSA for purposes of the final determination of dumping. These margins do not reflect the amount of anti-dumping duty to be levied on future importations of dumped goods.

In the event of an injury finding by the CITT, the dumping duty for future exports of subject goods will be determined on the basis of the margin of dumping of those specific goods. The margin of dumping is equal to the difference between the normal value and the export price of the goods. Where sufficient information is not provided or is not otherwise available to determine the normal value, the normal value will be determine by advancing the export price by 45.8%, pursuant to a Ministerial Specification.

For subject goods originating in or exported from China, the countervailing duty for future exports will be based on the specific amount of subsidy, per metric tonne, converted into Canadian dollars.

Please consult the SIMA Self-Assessment Guide for more detailed information explaining how to determine the amount of SIMA duties owing.

For the purposes of these investigations, certain fabricated industrial steel components are defined as follows:
