Notice of Initiation of Expiry Review Investigation

On December 10, 2018, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on December 20, 2013, in Expiry Review No. RR-2013-001, concerning the dumping of hollow structural sections originating in or exported from South Korea and Turkey.
As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping of the subject goods. The CBSA will make a determination no later than May 9, 2019, and will issue a Statement of Reasons by May 24, 2019.
The subject goods are structural tubing known as hollow structural sections made of carbon and alloy steel, welded, in sizes up to and including 16.0 inches (406.4mm) in outside diameter for round products and up to and including 48.0 inches (1,219.2 mm) in periphery for rectangular and square products, commonly but not exclusively made to ASTMA500, ASTMA513, CSA G.40.21-87-50W and comparable specifications, originating in or exported from South Korea and Turkey.

It is noted that prior to January 1, 2017, the subject goods were normally classified under the following tariff classification numbers:

As part of its expiry review investigation, the CBSA forwarded questionnaires to Canadian producers, importers and exporters. Any Canadian producers, importers or exporters who have not received a letter from the CBSA who wish to provide a response to the questionnaire are advised to contact the officer identified below. Responses to all questionnaires are due at the CBSA’s office in Ottawa by January 17, 2019.
