Certain Carbon Steel Fasteners
Notice of Expiry Review Determinations

On October 28, 2019, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on January 5, 2015, in Expiry Review number RR‑2014‑001, concerning the dumping of certain carbon steel fasteners originating in or exported from the People’s Republic of China (China) and the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) and the subsidizing of such goods originating in or exported from China (subject goods).

As a result of the CITT’s expiry review, on October 29, 2019, the Canada Border Services Agency (CBSA) initiated an expiry review investigation (investigation) to determine whether the expiry of the order is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods.

The investigation has now been completed and today the CBSA has determined, pursuant to paragraph 76.03(7)(a) of SIMA, that the expiry of the order:

  1. is likely to result in the continuation or resumption of dumping of certain carbon steel fasteners originating in or exported from China and the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei); and
  2. is likely to result in the continuation or resumption of subsidizing of certain carbon steel fasteners originating in or exported from China.

A Statement of Reasons that contains additional details concerning the determinations made by the CBSA will be issued within 15 days and will be posted on the CBSA’s website at: www.cbsa-asfc.gc.ca/sima-lmsi/er-rre/menu-eng.html.

The CITT will now conduct an expiry review to determine whether the expiry of its order is likely to result in injury to the domestic industry. The CITT has announced that it will issue its order by September 2, 2020. Anti‑dumping and countervailing duties will continue to apply to the subject goods until that date.

Product Definition

The subject goods are defined as:

“Certain carbon steel fasteners originating in or exported from the People’s Republic of China and the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), excluding fasteners specifically designed for application in the automotive or aerospace industry”.
