Notice of Initiation of Expiry Review Investigation

On November 20, 2018, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on December 18, 2013, in Inquiry No. NQ-2013-004, concerning the dumping of certain copper tube originating in or exported from Brazil, China, Greece, Mexico and South Korea, and the subsidizing of those goods originating in or exported from China.

As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the finding is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. The CBSA will make a determination no later than April 18, 2019, and will issue a Statement of Reasons by May 3, 2019.

The subject goods are circular copper tube with an outer diameter of 0.2 inch to 4.25 inches (0.502 centimetre to 10.795 centimetres) excluding industrial and coated or insulated copper tube, originating in or exported from Brazil, China, Greece, Mexico and South Korea.

As part of its expiry review investigation, the CBSA forwarded questionnaires to Canadian producers, importers, exporters and to the Government of China. Any Canadian producers, importers or exporters who have not received a letter from the CBSA who wish to provide a response to the questionnaire are advised to contact an officer identified below. Responses to all questionnaires are due at the CBSA’s office in Ottawa by December 28, 2018.
