Notice of initiation of administrative review: Steel Grating (SG 2025 UP1)

The Canada Border Services Agency (CBSA) has today initiated an administrative review (review) to determine normal values, export prices and an amount of subsidy applicable to certain steel grating originating in or exported from the People’s Republic of China (China) by Jiangsu Hengyuan International Engineering Co., Ltd.
The review follows requests for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on February 2, 2022, respecting the dumping and subsidizing of steel grating originating in or exported from China, in accordance with the Special Import Measures Act (SIMA).
The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s order (subject goods) can be found on the CBSA’s Steel Grating: Measures in force.
Normal values, export prices and an amount of subsidy established during this review will be effective for the subject goods released from the CBSA on or after the date of the conclusion of the review. Normal values, export prices and an amount of subsidy determined on the basis of the review will be applied to any entries of subject goods under appeal that have yet to be re-determined at the time of the conclusion of this review.
Should the exporter decide to participate in this review, they are required to provide complete and accurate responses to the CBSA’s requests for information (RFIs) by September 29, 2025, by 5:00 p.m. ET. The exporter will be considered cooperative if the requested information is complete, submitted on time and the exporter permits verification of the data. If the exporter does not provide sufficient information to determine specific normal values or does not permit verification of information submitted, anti-dumping duties will be assessed at a rate of 85.0%, expressed as a percentage of the export price, in accordance with a ministerial specification pursuant to section 29 of SIMA.
Similarly, in cases where either the Government of China or the exporter fails to provide complete and accurate submissions enabling the determination of a specific amount of subsidy, countervailing duty may be assessed at the rate of 13,064.00 Renminbi per metric tonne, in accordance with a ministerial specification pursuant to subsection 30.4(2) of SIMA.
Responses to the importer RFI are due by September 11, 2025, by 5:00 p.m. ET. Importers are cautioned that new normal values, when issued, may be higher than those currently in effect and that this could result in additional assessments of anti-dumping duties. Importers are also cautioned that unless an exporter co-operates in the administrative review and receives specific normal values at their conclusion, subsequent imports of subject goods from that exporter will be assessed anti-dumping duties based on ministerial specifications.
All parties are cautioned that where there are increases in domestic prices, and/or costs, the export price for sales to Canada should be increased accordingly to ensure that any sale made to Canada is not only above the normal value but at or above selling prices and full costs and profit of the goods in the exporter’s domestic market. If exporters did not adjust export prices accordingly, retroactive assessments of anti-dumping duty may be warranted.
As part of its administrative review, the CBSA forwarded questionnaires to importers and exporters. Any importers or exporters that have not received a letter from the CBSA that wish to provide a response to the questionnaire are advised to contact the CBSA SIMA Registry and Disclosure Unit at the email below.
