Notice of expedited review: Carbon steel welded pipe 2 (CSWP2 2023 XR)

In response to a request for an expedited review from KD Industries Inc., the Canada Border Services Agency (CBSA) has today initiated an expedited review of certain carbon steel welded pipe (CSWP) exported to Canada from the United Arab Emirates by KD Industries Inc., pursuant to subsection 13.2(3) of the Special Import Measures Act (SIMA).

This expedited review is part of the ongoing enforcement of the Canadian International Trade Tribunal’s (CITT) findings of material injury issued on December 11, 2012, respecting the dumping of CSWP from Chinese Taipei, India, Oman, the Republic of Korea, Thailand and the United Arab Emirates, and the amounts of subsidy of certain CSWP originating in or exported from India. The findings were subsequently reviewed and continued by order dated October 15, 2018.

The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s finding are contained in Appendix 1 (subject goods).

Should an exporter decide to participate in this expedited review, it is required to provide a complete and accurate response to the CBSA’s dumping request for information (RFI) by June 12, 2023. The exporter will be considered co-operative if the requested information is complete, submitted on time and the exporter permits verification of the data.

If an exporter does not provide a complete response to the RFI by the deadline date, normal values and export prices for subject goods exported by the exporter will be determined pursuant to a ministerial specification by advancing the export price of the goods from the United Arab Emirates by a rate of 54.2%.

The schedule for this expedited review is now available. The CBSA will close the record for this expedited review once it has been determined that sufficient information has been received to make a decision. The CBSA will update the website to announce that the record has been closed. Interested parties will have seven days from the close of the record to file submissions concerning the expedited review.

Normal values and export prices established during this review will apply to the goods in question. Further, normal values and export prices established during this review will also apply to subject goods released from the CBSA on or after the date of the conclusion of the expedited review. The normal values and export prices determined as a result of this review may be applied to any requests for re-determination of importations of subject goods that have not been processed prior to the conclusion of the expedited review, regardless of the date that the requests were received.

Appendix 1: Product definition

Carbon steel welded pipe, commonly identified as standard pipe, in the nominal size range from 1/2 inch up to and including 6 inches (12.7 mm to 168.3 mm in outside diameter) inclusive, in various forms and finishes, usually supplied to meet ASTM A53, ASTM A135, ASTM A252, ASTM A589, ASTM A795, ASTM F1083 or Commercial Quality, or AWWA C200-97 or equivalent specifications, including water well casing, piling pipe, sprinkler pipe and fencing pipe, but excluding oil and gas line pipe made to API specifications exclusively, originating in or exported from Chinese Taipei (excluding goods exported from Chinese Taipei by Chung Hung Steel Corporation and Shin Yang Steel Co. Ltd), the Republic of India, the Sultanate of Oman, the Republic of Korea, Thailand and the United Arab Emirates (excluding goods exported from the United Arab Emirates by Conares Metal Supply Ltd.).

Exclusions

  • 1 mm thick carbon steel tubing (SPCC-1, 25.6 mm in outside diameter), double coated (first coated with acrylonitrile butadiene styrene, then with polyvinyl chloride) and
  • non-galvanized, ASTM A53, Grade B, Schedule 80 pipe, with an inside diameter of 1 ¼ inches to 1 ½ inches, in 22-ft. lengths, with the inside weld scarfed, originating in/or exported from the Republic of Korea, and produced with AISI C1022M steel with a carbon content of 0.18 percent to 0.23 percent and a manganese content of 0.80 percent to 1.00 percent
