Notice of initiation of expiry review investigation

Ottawa, July 30, 2020

On July 29, 2020, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on September 25, 2015, in Inquiry No. RR-2014-004, concerning the dumping of certain whole potatoes imported from the United States of America, for use or consumption in the province of British Columbia.

As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping of the subject goods. The CBSA will make a determination no later than December 24, 2020, and will issue a Statement of Reasons by January 8, 2021.

The subject goods are “Whole potatoes, excluding seed potatoes, excluding imports during the period from May 1 to July 31, inclusive, of each calendar year; and excluding red potatoes, yellow potatoes and exotic potato varieties, regardless of packaging, and white and russet potatoes imported in 50-lb cartons in the following count sizes: 40, 50, 60, 70 and 80, imported from the United States of America, for use or consumption in the province of British Columbia.”

As part of its expiry review investigation, the CBSA has solicited responses to questionnaires from Canadian producers, importers and exporters. Any Canadian producers, importers or exporters who have not received a letter from the CBSA who wish to provide a response to the questionnaire are advised to contact the CBSA SIMA Registry and Disclosure Unit at the email address included below. Responses to all questionnaires are due at the CBSA SIMA Registry and Disclosure Unit’s email address by September 8, 2020.
