Notice of conclusion of expiry review investigation: Copper Tube (CT 2024 ER)

On August 12, 2024, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), gave a notice of initiation of an expiry review of its orders made on September 25, 2019, in Expiry Review No. RR-2018-005, concerning the dumping of copper tube originating in or exported from Brazil, China, Greece, Mexico and South Korea and the subsidizing of those goods originating in or exported from China.

As a result, on August 13, 2024, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the orders is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the CBSA has determined that the expiry of the orders:

  1. is likely to result in the continuation or resumption of dumping of such goods originating in or exported from Mexico
  2. is likely to result in the continuation or resumption of dumping of such goods originating in or exported from Brazil, China, Greece and South Korea and
  3. is likely to result in the continuation or resumption of subsidizing of such goods originating in or exported from China

A Statement of Reasons that contains additional details concerning the determinations made by the CBSA, will be issued within 15 days.

The CITT will now conduct an inquiry to determine whether the expiry of its orders is likely to result in injury to the Canadian industry, and will issue its decision no later than June 18, 2025.
