HRSS 2021 ER: Certain flat hot-rolled carbon and alloy steel sheet and strip
Notice of expiry review investigation

On July 9, 2021, the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on August 12, 2016, in Expiry Review No. RR-2015-002, concerning the dumping certain flat hot-rolled carbon and alloy steel sheet and strip originating in or exported from Brazil, China and Ukraine and the subsidizing of certain flat hot-rolled carbon and alloy steel sheet and strip originating in or exported from India.

As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the expiry of the order is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. The CBSA will make a determination no later than December 6, 2021, and will issue a Statement of Reasons by December 21, 2021.

The subject goods are:

“flat hot-rolled carbon and alloy steel sheet and strip, including secondary or “non-prime” material, originating in/or exported from Brazil, China, India and Ukraine, in various widths from 0.75 in. (19 mm) and wider,

  1. for products in coil form, in a thickness of 0.054 in. to 0.625 in. (1.37 mm to 15.875 mm) inclusive,
  2. for products that are cut-to-length, in a thickness of 0.054 in. up to but not including 0.187 in. (1.37 mm up to but not including 4.75 mm).”

Exclusions

Flat-rolled stainless steel sheet and strip and flat hot-rolled, cut-to-length alloy steel products containing no less than 11.5% manganese, in thickness from 0.12 in. to 0.19 in. (3 mm to 4.75 mm).

As part of its expiry review investigation, the CBSA has solicited responses to questionnaires from Canadian producers, importers, exporters and the Government of India. Any Canadian producers, importers or exporters who have not received a letter from the CBSA who wish to provide a response to the questionnaire are advised to contact the CBSA SIMA Registry and Disclosure Unit at the email address included below. Responses to all questionnaires are due at the CBSA SIMA Registry and Disclosure Unit’s email address by August 18, 2021.
