Update to the Special Import and Measures Act Handbook
Ottawa,
Please be advised that chapter 2 of the Special Import and Measures Act (SIMA) Handbook has been updated. The changes reflected in this section were completed in an effort to remove outdated processes while strengthening and streamlining the disclosure provisions under SIMA and the Confidentiality and disclosure guidelines for Special Import and Measures Act proceedings.
It is recommended that individuals request a copy of the newly revised SIMA Handbook as the changes reflected therein are effective immediately. Please contact the SIMA Registry to request a copy in either official language.
A brief outline of the changes is:
- The CBSA reserves the right to provide for a more limited deadline under section 87 of SIMA when the time limit cannot be respected without impeding the legislated investigating timelines, and to ensure timely availability of information for all SIMA stakeholders
- The CBSA has repealed its existing policy relating to the disclosure of confidential information to non-resident counsel and will no longer be processing non-resident disclosure undertakings
