Product Description

The submitted product is a maternity support belt. This lightweight elastic belt offers a Velcro closure and is said to relieve back pain during pregnancy by providing additional support to a woman's growing belly.

Analysis and Justification

Note 1 b) to Chapter 90 states that supporting belts or other support articles of textile material, whose intended effect on the organ to be supported or held derives solely from their elasticity (for example, maternity belts, […]), are to be classified under Section XI.

Heading 62.12 covers, inter alia, articles of a kind designed for wear as body-supporting garments. These articles may be made of any textile material. According to Explanatory Note to heading 62.12, maternity, post-pregnancy or similar supporting or corrective belts, not being orthopaedic appliances as defined in Note 6 to Chapter 90, are covered under heading 62.12.

Section 10 of the Customs Tariff directs that classification of imported goods shall be determined in accordance with the General Rules for the Interpretation of the Harmonized System. Section 11 of the Customs Tariff states that in interpreting the headings and subheadings, regard shall be had to the World Customs Organization's Explanatory Notes to the Harmonized Commodity Description and Coding System.

General Interpretative Rule 1 (GIR 1) directs that titles of Sections, Chapters and sub-Chapters are provided for ease of reference only. For legal purposes, classification shall be determined according to the terms of the heading and any relative Section and Chapter Notes. Similarly, General Interpretative Rule 6 (GIR 6) directs that classification shall be determined according to the terms of those subheadings and any related Subheading Notes.

The Support Belt T20-57307F is classified under tariff classification number 6212.90.00.00 of the Canadian Customs Tariff. This classification is in accordance with GIR 1 and 6 of the Harmonized System.
