Waterproof Footwear and Bottoms of Rubber and Plastic

The Canada Border Services Agency (CBSA) has initiated a re-investigation of the normal values and export prices of certain waterproof footwear and bottoms made of plastic or rubber from the People's Republic of China.

The subject goods are described as waterproof footwear and bottoms of plastic or rubber, including moulded clogs, originating in or exported from China, excluding ski boots, skating boots and all footwear subject to the order made by the Tribunal in Review No. RR-97-001.

The re-investigation is part of the CBSA's enforcement of the Canadian International Trade Tribunal's order issued on December 7, 2005.

The subject goods are usually classified under the Harmonized System (HS) Heading 6401, 6402, 6403 and 6404 under the following HS Codes:

The CBSA has requested information relating to the subject goods from possible exporters and importers of subject goods. All parties have been clearly advised of the CBSA's information requirements and the time frames for providing their responses.

Exporters that wish to participate are required to provide a complete and accurate submission by November 27, 2009. For exporters that co-operate with the CBSA in this re-investigation, the normal values that are established will be effective for subject goods released from the CBSA on or after February 23, 2010, or the date of the ruling letter to the exporter, whichever occurs first. In addition, the new normal values may be applied to any entries of subject goods under appeal that have yet to be re-determined at the time of the conclusion of this re-investigation.

When sufficient information has not been submitted to the CBSA to permit the determination of specific normal values for subject goods, the normal values will be determined on the basis of an advance of 49% over the export price in accordance with a ministerial specification pursuant to section 29 of Special Import Measures Act. This will result in the assessment of anti-dumping duty at the rate of 49% of the export price
