Garlic

On August 26, 2005, the Canadian International Trade Tribunal (Tribunal), pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on May 2, 2001, in Inquiry No. NQ 2000-006, concerning garlic, fresh or frozen, originating in or exported from the People's Republic of China and Vietnam, excluding fresh garlic subject to the Tribunal finding in Inquiry No. NQ-96-002, and its order made on March 20, 2002, in Inquiry No. RR-2001-001, concerning fresh garlic originating in or exported from the People's Republic of China, imported into Canada from July 1 to December 31, inclusive, of each calendar year. As a result, the President of the Canada Border Services Agency (the President) initiated an investigation on August 29, 2005, to determine whether the expiry of the finding and the order are likely to result in the continuation or resumption of dumping of the goods.

The investigation has now been completed and today, pursuant to paragraph 76.03(7)(a) of SIMA, the President has determined that the expiry of the finding and the order are likely to result in the continuation or resumption of dumping of the goods.

A Statement of Reasons containing additional details concerning the determination made by the President will be issued within fifteen days. The Statement of Reasons will be posted at the following Web site: www.cbsa-asfc.gc.ca/sima-lmsi/er-rre/menu-eng.html.

The Tribunal will now conduct an inquiry to determine whether the expiry of the finding and/or the order are likely to result in injury or retardation to the Canadian industry, and will make its decision by May 1, 2006.
