On August 9, 2001, the Canadian International Trade Tribunal (Tribunal) initiated an expiry review pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA). This expiry review relates to the Tribunal's order made on April 21, 1997, in Review No. RR-96-004, continuing with amendment the Tribunal's finding made on April 21, 1992, in Inquiry No.
NQ-91-006, concerning machine tufted carpet originating in or exported from the United States of America.
As a consequence of the Tribunal's initiation of the expiry review, the Commissioner of Customs and Revenue (Commissioner) commenced an investigation on August 10, 2001, to determine whether the expiry of the Tribunal's order is likely to result in the continuation or resumption of dumping of the goods.
The investigation has now been completed and, today, pursuant to paragraph 76.03(7)(a) of SIMA, the Commissioner has determined that the expiry of the order made by the Tribunal is unlikely to result in the continuation or resumption of dumping of the subject goods originating in or exported from the United States of America.
A Statement of Reasons which contains additional details concerning the determination made by the Commissioner will be issued within fifteen days. The Statement of Reasons will be posted on the SIMA Web site at http://www.cbsa-asfc.gc.ca/sima-lmsi/er-rre/rr2001-003/rr2001-003s-eng.html
Pursuant to subparagraph 76.03(12)(a)(i) of SIMA, the Tribunal will rescind its order respecting the subject goods. The scheduled expiry date of the order is April 20, 2002.
