1. The Canada Border Services Agency (CBSA) is issuing this notice to clarify terms and conditions that must be met by the licensee of an SO (CSA) sufferance warehouse with respect to the operation of their warehouse facility.
2. The CBSA established the type SO (CSA) sufferance warehouse to allow CSA EDI carriers the ability to move their shipments, which were unable to be processed electronically at the border, directly inland and therefore not delay other shipments on their conveyance. Examples of instances where this would be applicable are: Failed PARS; systems outages; OGD shipments requiring paper permits/ certificates; shipments with invoicing exceeding 999 lines, etc. The SO (CSA) warehouse is not to be used to store goods that were planned in-bond cargo movements.
3. In order to qualify for a type SO (CSA) sufferance warehouse licence, the carrier must:
4. The SO (CSA) sufferance warehouse is intended to hold only shipments that are reported at the first point of arrival under the SO (CSA) sufferance warehouse licence holder’s carrier code. The carrier who operates the SO (CSA) warehouse is not permitted to use the SO (CSA) warehouse to hold goods that are reported at the first point of arrival under another carrier’s code.
5. Failure by an SO (CSA) sufferance warehouse licensee to comply with these requirements will result in CBSA corrective action and/or sanctions up to and including cancellation of their SO (CSA) sufferance warehouse licence.
